M\u00e9xico, M\u00e9xico.<\/strong>\u2013 La televisora <strong>TV Azteca<\/strong>, propiedad de <strong>Ricardo Salinas Pliego<\/strong>, perdi\u00f3 la protecci\u00f3n legal que hab\u00eda frenado el cobro de una deuda de <strong>580 millones de d\u00f3lares<\/strong> con inversionistas internacionales, luego de que un tribunal federal <strong>anul\u00f3 las medidas cautelares<\/strong> que la favorec\u00edan.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El <strong>D\u00e9cimo Tribunal Colegiado en materia Civil de la Ciudad de M\u00e9xico<\/strong> resolvi\u00f3 el pasado <strong>22 de octubre<\/strong> un amparo promovido por <strong>The Bank of New York Mellon<\/strong> y su filial en Londres, determinando que la suspensi\u00f3n de obligaciones otorgada por un juez civil carec\u00eda de fundamento jur\u00eddico y era desproporcionada frente a la magnitud del adeudo.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El proyecto, elaborado por el magistrado <strong>Juan Jaime Gonz\u00e1lez Varas<\/strong>, fue aprobado <strong>por unanimidad<\/strong>, y en \u00e9l se enfatiza que la suspensi\u00f3n de pagos concedida a la televisora <strong>fue ilegal y sin sustento t\u00e9cnico ni econ\u00f3mico.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">\u2696\ufe0f <strong>Una deuda multimillonaria que persigue a la televisora<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">El conflicto se origin\u00f3 en <strong>mayo de 2022<\/strong>, cuando el banco estadounidense dio por <strong>vencido anticipadamente el contrato de emisi\u00f3n de bonos<\/strong> con TV Azteca, ante el incumplimiento de los pagos correspondientes.<br>La empresa mexicana respondi\u00f3 con una demanda mercantil, alegando que la <strong>pandemia de Covid-19<\/strong> fue un caso fortuito que le impidi\u00f3 cumplir con sus compromisos financieros.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sin embargo, el tribunal fue claro: <strong>la pandemia no constituye una justificaci\u00f3n legal v\u00e1lida<\/strong> para incumplir obligaciones contractuales, citando una jurisprudencia emitida por la <strong>Suprema Corte de Justicia de la Naci\u00f3n (SCJN)<\/strong> en 2024, que cerr\u00f3 la puerta a ese tipo de argumentos.<\/p>\n\n\n\n<p class=\"wp-block-heading\">\ud83d\udcbc <strong>Un fallo con repercusiones financieras y legales<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">La decisi\u00f3n judicial deja abierta la posibilidad de que las <strong>autoridades financieras mexicanas puedan ejecutar el cobro o incluso ordenar el embargo de activos<\/strong> de TV Azteca en territorio nacional.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El tribunal consider\u00f3 que la garant\u00eda presentada \u2014de <strong>poco m\u00e1s de un mill\u00f3n de pesos<\/strong>\u2014 resultaba <strong>rid\u00edculamente insuficiente<\/strong> frente al monto total de la deuda, equivalente a casi <strong>10 mil millones de pesos mexicanos.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Durante su intervenci\u00f3n, el magistrado Gonz\u00e1lez Varas record\u00f3 que las figuras de \u201c<strong>apariencia del buen derecho<\/strong>\u201d y \u201c<strong>peligro en la demora<\/strong>\u201d utilizadas para justificar la suspensi\u00f3n <strong>no aplican en materia mercantil<\/strong>, lo que debilit\u00f3 a\u00fan m\u00e1s la defensa de la televisora.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h3 class=\"wp-block-heading\">\ud83d\udcac <strong>La ley no distingue entre gigantes y ciudadanos<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">M\u00e1s all\u00e1 del tama\u00f1o del corporativo o la influencia medi\u00e1tica, este caso recuerda que <strong>la justicia econ\u00f3mica no puede estar al servicio del poder empresarial<\/strong>.<br>En un pa\u00eds donde miles de peque\u00f1as empresas luchan por sobrevivir a la falta de pago o a la burocracia financiera, <strong>ver a una de las televisoras
